Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Kinjo Pro ("Kinjo," "we," "us," or "our") governing your access to and use of kinjo.pro (the "Site") and the Kinjo AI call-answering, lead follow-up, appointment-booking, and reputation software and related services (collectively, the "Service"). By visiting the Site, requesting a demo, placing a test call, or subscribing to the Service, you agree to these Terms. If you are agreeing on behalf of a business, you represent that you have authority to bind that business, and "you" refers to that business.

If you do not agree to these Terms, do not use the Site or the Service.

1. The Service

Kinjo provides AI-powered software for home-services businesses ("Customers") that answers and routes inbound calls, follows up with missed and new leads by phone, text (SMS), and email, books appointments to a calendar, requests customer reviews, and reports on activity. Features, call/text volume, and integrations vary by subscription plan and configuration and may change as we improve the Service.

Kinjo is not a phone carrier, answering service staffed by a live human operator by default, or an emergency services provider. The Service must never be used to place or route calls to 911 or another emergency number, and Kinjo is not a substitute for emergency communications.

2. Accounts, Plans & Billing

Paid plans start at $97/month; current pricing, term length, and included usage are set out in your order form, quote, or the plan you select at checkout. Unless stated otherwise, subscriptions renew automatically for successive billing periods at then-current pricing until cancelled. You are responsible for keeping your account, billing, and contact information accurate and current, and for all activity under your account credentials.

You may cancel at any time effective at the end of your current billing period by contacting us at the phone number below or through your account. Except where required by law or expressly stated in your order form, fees already paid are non-refundable, and we do not provide partial-month or usage-based refunds.

We may change our fees prospectively; we will give you reasonable advance notice before a price change applies to your next renewal.

3. Free Test Line & Demos

The free test line, live demo, and Growth Score tool are provided to let you evaluate the Service before subscribing. Calls to the test line may be recorded and reviewed for quality, training, and product-improvement purposes, and by placing a test call you consent to that recording. Demo and test-line usage may be limited in volume, duration, or availability at our discretion.

4. Your Responsibilities & Required Consents

You are solely responsible for how you use the Service to contact, call, text, and record your own customers and prospects ("End Recipients"). Before using Kinjo to call, text, or record any End Recipient, you represent and warrant that you have obtained every consent, license, or authorization required by applicable law, including without limitation:

(a) the federal Telephone Consumer Protection Act (TCPA) and applicable state telemarketing and autodialer laws, including any required prior express written consent for automated or AI-generated calls and texts;

(b) state two-party and one-party call-recording and wiretap laws, which may require you to disclose that a call is being recorded or handled by an AI system before the call proceeds;

(c) the CAN-SPAM Act and applicable SMS/CTIA messaging guidelines, including honoring opt-out requests (e.g., "STOP") promptly; and

(d) federal and state Do-Not-Call registry requirements.

You agree to indemnify and hold Kinjo harmless from claims arising out of your failure to obtain or honor these consents. Kinjo may suspend or terminate the Service immediately if we reasonably believe your use creates legal or regulatory risk for you, your End Recipients, or Kinjo.

5. AI-Generated Communications

Some calls and texts placed through the Service are generated or assisted by artificial intelligence rather than a live human. You are responsible for ensuring your own scripts, disclosures, and use of the Service comply with any law in your jurisdiction requiring disclosure that a caller or texter is interacting with an automated or AI system, and for configuring the Service to include such disclosures where required.

6. Acceptable Use

You agree not to use the Service to: send unsolicited bulk messages or "spam"; harass, defraud, deceive, or impersonate any person or business; transmit unlawful, defamatory, or infringing content; attempt to interrupt, reverse-engineer, scrape, or gain unauthorized access to the Service or its underlying models and data; or resell the Service to third parties without our written consent.

7. Intellectual Property

Kinjo and its licensors own all right, title, and interest in the Site, the Service, and all underlying software, models, and content, excluding data you submit ("Customer Data"). Subject to these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable right to access and use the Service for your internal business purposes. You retain ownership of your Customer Data; you grant Kinjo a license to host, process, and use Customer Data solely to provide, maintain, and improve the Service for you, consistent with our Privacy Policy.

8. Third-Party Services

The Service is built on and integrates with third-party infrastructure, including our CRM, messaging, and calendar systems provider, telephony carriers, hosting providers, and AI/voice-model providers. Your use of the Service is also subject to the acceptable-use terms of those providers where applicable, and Kinjo is not responsible for outages or changes originating from third-party providers outside our control.

9. Disclaimers

Results referenced on the Site (missed-call recovery, booked-jobs figures, revenue estimates, and similar) are illustrative examples and are not a guarantee of performance; actual results vary by trade, market, call volume, and how the Service is configured. Except as expressly stated in a signed order form, the Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the maximum extent permitted by law, Kinjo will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost business, arising out of or relating to the Service. Kinjo's total liability arising out of or relating to these Terms or the Service will not exceed the amount you paid Kinjo in the three (3) months preceding the event giving rise to the claim.

11. Term & Termination

These Terms remain in effect while you use the Site or subscribe to the Service. We may suspend or terminate access for breach of these Terms, non-payment, or conduct that creates legal, security, or reputational risk. Sections that by their nature should survive termination (including Sections 4, 7, 9, 10, and 12) will survive.

12. Governing Law & Disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute arising out of these Terms or the Service will be resolved in the state or federal courts located in California, and each party consents to personal jurisdiction there, unless a separate signed agreement between you and Kinjo provides otherwise.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, for active subscribers, provide reasonable notice (such as email or in-product notice). Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
